La Prassi Bancaria Internazionale Uniforme (PBIU) INTERNATIONAL STANDARD BANKING PRACTICE (ISBP), approvata per la prima volta dalla ICC Banking Commission nel 2002 (pubblicazione 645), aggiornata nel 2007 (pubblicazione 681) e nuovamente nel 2013 (pubblicazione 745), rappresenta un insostituibile aiuto per tutti gli operatori che utilizzano i crediti documentari.
I componenti della ICC Banking Commission e, in generale, gli utilizzatori delle regole per i crediti documentari hanno ritenuto opportuno, in considerazione della sempre maggiore applicazione delle prassi individuate nelle PBIU, un allineamento della Pubblicazione con quelle più recenti riscontrate nella finanza commerciale.
Come annunciato nella riunione plenaria tenutasi a Parigi il 20 ottobre 2022, lo Steering Committee della Banking Commission, dietro suggerimento dei Comitati Nazionali, ha costituito un Gruppo di Lavoro al fine di avviare una revisione parziale della Prassi 745.
L’obiettivo era quello di passare in rassegna tutti i Pareri (Opinions) ICC approvati a partire dalla pubblicazione della PBIU 745, avvenuta nel 2013, e di garantire che la Prassi fosse pienamente allineata al loro contenuto. Sono stati, quindi, esaminati tutti i Pareri approvati tra ottobre 2013 e gennaio 2023.
Tale revisione, peraltro, si è limitata a garantire l’allineamento tra i testi precedentemente approvati e ha consentito di contenere tutto il materiale rilevante in un’unica pubblicazione.
L’esito di questo esame ha portato all’individuazione di nove Pareri con contenuti significativi meritevoli di essere inclusi nella PBIU, riepilogati di seguito:
- Nuova Considerazione Preliminare viii), secondo cui l’assenza di un numero di credito, o l’errata digitazione di un numero di credito, su un documento non costituisce motivo valido di rifiuto. (Parere 876rev)
- Nuova Considerazione Preliminare ix), che stabilisce che condizioni amministrative quali la richiesta di un’ulteriore fotocopia di tutti i documenti, o una dichiarazione che tutti i documenti non possono essere pinzati, non dovrebbero essere incorporate in un credito da una banca emittente. - Aggiunta la parola “Industrie” al paragrafo A1 (Abbreviazioni). (Parere 837rev)
- Aggiunto un nuovo paragrafo A17 (b) in “Documenti e caselle, campi o spazi da compilare”, in cui si afferma che non è richiesto che il nome, l’indirizzo e i dettagli di contatto (se presenti) del richiedente compaiano in una casella, campo specifico o spazio su una fattura. (Parere 818rev)
- Aggiunto il nuovo paragrafo A31 (b) in “Copia dei documenti”, in cui si afferma che non è necessario firmare le copie dei documenti (Parere 842rev3). Il preesistente paragrafo A31 (b) è stato spostato in A31 (c)
- Aggiunto il nuovo paragrafo C7 “Questioni generali relative alle fatture”, che prevede che una fattura presentata a fronte di un credito emesso in USD, recante solo il simbolo “$” senza ulteriori precisazioni, soddisfi il requisito del sub-articolo 18 (a) (iii) delle NUU 600, a meno che i dati contenuti nella fattura stessa, o in un altro documento presentato, implichino che il simbolo “$” possa riferirsi a una valuta diversa dal dollaro statunitense. - Aggiunti nuovi paragrafi D5 (e) in “Documento di trasporto multimodale o combinato”, E5 (e) in “Polizza di carico”, e F4 (e) in “Polizza di carico non negoziabile”, che stabiliscono che la firma del comandante (captain) può essere accompagnata da un timbro che include il nome della nave. - Aggiunto il nuovo paragrafo G4 (c) “Polizza di carico per contratto di noleggio”, che stabilisce che la firma del comandante (captain) può essere accompagnata da un timbro che include il nome della nave. (Parere 836rev)
- Aggiunto il nuovo paragrafo K2 (b), che afferma che le NUU 600 non richiedono che un agente o un procuratore debba essere nominato in un documento assicurativo. Il preesistente paragrafo K2 (b) è stato spostato in K2 (c). (Parere 835rev)

Since its initial publication in 2002 (Publication 645), International Standard Banking Practice (ISBP) has become an invaluable aid to trade finance professionals when creating documents for presentation under, or for the examination of documents presented under, a documentary credit. It comprises a compilation of banking practices that are to be applied when working with documentary credits that are subject to UCP 600. ISBP demonstrates how the principles and content of UCP 600 should be integrated into day-to-day practice by providing readers with detailed practices that are to be considered and applied when working with different trade documents (invoices, transport documents, insurance documents, certificates of origin…). ISBP also provides coverage of documents which are not specifically mentioned in UCP.

International Standard Banking Practice — 2023 edition is the most up to date guide for the examination of documents under documentary credits reflecting practices agreed by ICC national committees. It also serves as an aid to a beneficiary of a documentary credit in its creation and presentation of documents to a nominated bank or issuing bank. The publication should always be read in conjunction with UCP 600.
